Brandenburgisches Vorschriftensystem

Auf Grund des § 9a Abs. 3 des Bundesfernstraßengesetzes in der Fassung der Bekanntmachung vom 20. Februar 2003 (BGBl. I S. 286) verordnet der Minister für Stadtentwicklung, Wohnen und Verkehr nach Anhörung des Landkreises Spree-Neiße und der Stadt Forst:

§ 1

(1) Zur Sicherung der Planung für den Neubau der Bundesstraße 112 als Ortsumgehung Forst, die im vordringlichen Bedarf des Bedarfsplanes für Bundesfernstraßen als Teilabschnitt der Oder-Lausitz-Straße aufgenommen ist sowie für die Fortschreibung des Bedarfsplanes für Bundesfernstraßen angemeldet ist, wird ein Plangebiet festgelegt.

(2) Die Realisierung soll ab 2004 erfolgen.

(3) Um nachteilige Veränderungen im Sinne des § 9a Abs. 1 des Bundesfernstraßengesetzes zu vermeiden, wird entsprechend § 9a Abs. 3 diese Veränderungssperre vorgenommen.

(4) Das Planungsgebiet wird für die Gemarkungen Forst, Mulknitz und Klein Jamno festgelegt. Es beinhaltet die in der Anlage aufgeführten Flurstücke.

§ 2

(1) Vom Tage des In-Kraft-Tretens dieser Verordnung an dürfen auf den im Planungsgebiet liegenden Flächen wesentliche wertsteigernde oder den geplanten Straßenbau erheblich erschwerende Veränderungen nicht vorgenommen werden. Ausnahmen können nach § 9a Abs. 5 des Bundesfernstraßengesetzes zugelassen werden, wenn überwiegend öffentliche Belange nicht entgegenstehen. Über Ausnahmen entscheidet als untere Straßenbaubehörde das Brandenburgische Straßenbauamt Cottbus.

(2) Veränderungen, die in rechtlich zulässiger Weise vor dem In-Kraft-Treten der Verordnung begonnen worden sind, Unterhaltungsarbeiten und die Fortführung einer bisher ausgeübten Nutzung werden hiervon nicht berührt (§ 9a Abs. 1 und 3 Satz 4 des Bundesfernstraßengesetzes). Zuwiderhandlungen können gemäß § 23 Abs. 1 Nr. 10 und § 23 Abs. 2 des Bundesfernstraßengesetzes als Ordnungswidrigkeiten mit einer Geldbuße geahndet werden.

§ 3

Diese Verordnung tritt am Tage nach der Verkündung in Kraft. Sie tritt mit Beginn der Auslegung der Pläne im Planfeststellungsverfahren nach § 17 des Bundesfernstraßengesetzes außer Kraft, spätestens jedoch zwei Jahre nach dem Verkündungstag.
